Chinese Supreme Court visits JIPA

On the occasion of the Japanese government''s invitation of the officials from the Supreme People''s Court of the People''s Republic of China, on March 1, 2011, JIPA welcomed the visit of the 6 member delegation (3 judges from the civil division, 2 judges from the criminal division, and 1 judge from the foreign affairs division) headed by Senior Judge Zhang Shengzu at its office, and arranged a meeting between these visitors and the IIPPF members, mainly JIPA”Ēs Asia PJ members.

At this meeting, the participants took up the IIPPF''s three recommendations for which both parties were unable to exchange their opinions sufficiently when the IIPPF working-level mission visited China in November 2010, namely, (1) "Strengthening measures against repeated illegal conduct," (2) "Strengthening measures against increasingly-ingenious modes of illegal conduct," and (3) "Enhancement of counterfeiters'' civil liability for damages." Among them, Judge Zhang explained Recommendation (2), which had already been discussed among the relevant authorities of China, while also mentioning the authorities'' legal interpretations As for the remaining two recommendations, (1) and (3), Judge Zhang introduced the current judicial interpretations and other information, with a comment that the Chinese authorities would like to make reference to these recommendations in their future discussions.

During the one-week tour in Japan that began with this opinion exchange, the delegation is scheduled to engage in activities such as giving a lecture at the seminar on protection of intellectual property in China, and visiting various sites in Japan, including the IP High Court and the Osaka High Court, private companies, and markets.
