Opinion Exchange with SIPO, Academy of Social Sciences and others

JIPA”Ēs Asia PJ dispatched a delegation of nine members led by Mr. Bessho (HONDA), Managing Director of JIPA, to China (Beijing) during September 16 to 20, 2014. This delegation visited government agencies such as the State Intellectual Property Office(SIPO) and the Academy of Social Sciences as well as famous jurists having influences on IP law-related legislation of China, and exchanged opinions on the Patent Law, the Trademark Law, and so on.

As for the draft of the employee's invention ordinance, it was revealed that some drafts had been considered within the government several times but the government was prevented from establishing a bill by the difficulty of adjustment. Since such situations have not changed for the draft of this time, there is also a possibility that it will not ultimately become a bill, and we need to continue to present proposals and watch the future trends.

As for the establishment of the IP-Law Court, we could straightforwardly understand the following circumstances: the establishment of the IP-Law Court of this time was led by the initiative of the Communist Party. As a future outlook, the IP-Law Court will be tentatively established in three regions of Beijing, Shanghai, and Guangzhou at the level of the Intermediate People's Court and the subsequent direction of the institutional reform will be determined depending on the results of the observation for 3 years. As for the establishment of the IP-Law Court, JIPA submitted an assenting opinion and we will also continue to watch the development in this matter.

At this visit, we not only took the conventional proposal approach of visiting government agencies and conveying JIPA's requests but also tried the approach of visiting prominent jurists and so on having influences on the legislation and leading the domestic discussion and conveying JIPA's requests. We received a variety of comments from the jurists and attained multifaceted collection of Chinese information and therefore, we believe that this is very effective in that we had the contents of JIPA's proposals evaluated and commented from the standpoint of a third party.
