Opinion exchange with Trademark examiners of Taiwan Intellectual Property Office (TIPO)

On August 21, four member of JIPA Strategy to Asia PJ had opinion exchange with Trademark examiners of Taiwan Intellectual Property Office (TIPO) at Research Institute of Economy, Trade and Industry (RIETI). TIPO officers came to Japan to study Japanese Trademark System.

First of all, JIPA member introduced JIPA’s organization and activities and then explained trademark practice and trademark management in Japanese companies, the gist of the proposals on the amendment bill for Taiwanese trademark law which JIPA submit to TIPO last March. A trademark committee member told some requirements for Taiwanese trademark system which is now under consideration in the committee and asked for TIPO’s opinions against the requirements.

On the other hand, TIPO sought comments from JIPA on communication difficulties. Some Japanese companies sometimes do not provide evidences. The cause could be a lack of communication between Japanese company and Taiwanese agent, so TIPO wanted to know how they can contact Japanese companies directly. JIPA answered that Japanese companies does not have such needs, because they have generally no other choice but to ask local agent because of language problem. TIPO pointed another matter. As Taiwanese patent system does not admit a comprehensive description, there are some time-consuming applications which need many amendments to add concrete designated goods description.

Although it was a short meeting, JIPA could told what we want directly to TIPO examiners, and it was a meaningful discussion,
